Car accident in Jacksonville Beach, Florida

Injured in a car crash in Jacksonville Beach? We can help.

Traffic at the beach changes with the seasons. Summer weekends, holidays and big events bring heavy traffic, visitors who don’t know the roads, and more people walking and biking near the ocean. When a careless driver causes a crash, you can be left with medical bills, missed work and an insurance company pushing for a quick, low settlement.

Since 1974, Terrell Hogan Law has represented people hurt by negligent drivers across Northeast Florida, including Jacksonville Beach, Neptune Beach, Atlantic Beach and Ponte Vedra Beach. We prepare every case as if it will go to trial, so insurers know we’re ready if they don’t make a fair offer.

  1. Call 911 and make sure a police report is made.

  3. If it is safe, take photos of the vehicles, the scene and your injuries, and get witness names and numbers.
  4. Do not give a recorded statement to the other driver’s insurance company before you talk to a lawyer.
  5. Keep your medical bills, records and proof of missed work.

Florida rules that affect your car accident claim

  • See a doctor within 14 days. Your Personal Injury Protection (PIP) coverage pays only if you get initial medical care within 14 days of the crash.
  • PIP has limits. It generally covers 80% of medical bills and 60% of lost income, up to $10,000. It does not pay for pain and suffering.
  • Pain and suffering requires a serious injury. You can make that claim against the at-fault driver if the crash caused a permanent injury, significant scarring or disfigurement, or death.
  • The deadline is usually two years. For most crashes on or after March 24, 2023, a negligence lawsuit must be filed within two years of the crash.
  • Fault matters. Your recovery is reduced by your share of fault. If you are found more than 50% at fault, you cannot recover from the other driver.
  • Uninsured motorist coverage can save a case. Florida does not require drivers to carry bodily injury liability insurance, so your own UM coverage is often what pays.
