Mesothelioma, Asbestos, and Lung Cancer

In the early decades of the past century, despite knowing about the deadly dangers of asbestos, corpo­rations in asbestos mining, milling and manufac­turing chose to conceal this life-saving infor­mation from their workers, who were not given the choice to protect themselves from breathing in asbestos fibers. And asbestos companies chose not to disclose the hazard to other workers who prepared, applied and worked around asbestos-containing products. As a result, many millions of workers were exposed to asbestos carcinogens and millions developed asbestos-related disease. Even today, mesothelioma, a crushing malignant tumor, continues to be diagnosed.

In 1981, Wayne Hogan repre­sented Ed and Patsy Janssens in Florida’s first asbestos disease trial with a punitive damages verdict, a total verdict of over $1.8 million, and successfully defended the judgment in the precedent-setting appeal, Johns-Manville Sales Corp. v. Janssens, 463 So.2d 262 (Fla. 1st DCA 1984). This case upheld the right of injured workers to hold corpo­rations liable for punitive damages in such toxic tort litigation and also affirmed, in the right cases, to the award of multiple punitive damage verdicts to punish wrongdoers and to warn against recklessness by other corporations.

In another of the firm’s cases tried and defended on appeal by Hogan, the Florida Supreme Court held that a corporate merged successor is liable for punitive damages for the recklessness of prede­cessor corpo­rations in Celotex Corp. v. Pickett, 490 So.2d 35 (Fla. 1986), where the verdict was $600,000, and included punitive damages.
